Solicitar un NIE de No-Residente

Desde este verano, han modificado el procedimiento para la obtención de un NIE de No-Residente. No debemos confundir este Número de Identificación con carácter fiscal, con el permiso de trabajo o residencia (NIE). Aunque los procedimientos de estos últimos también han cambiado, acomodándose al nuevo Reglamento de Extranjería.

Since this last summer, it´s been modified the proceeding in order to obtain a Non Resident NIE. We must not confound this number which is for tax identification with the work or residence permit. Although the proceedings for obtaining this last ones, have had changes, due to the new “Reglamento de Extranjeria”.

Cuando un ciudadano extranjero quiere realizar una operación mercantil en España, como la compra de un vehículo, la constitución de una sociedad, etc. ha de disponer de un NIE. Si no dispone de permiso de trabajo o residencia (por no residir en España) ha de solicitar este número fiscal.

When a foreigner citizen wants to do a mercantile operation in Spain, like buying a vehicle, creation of a new company, etc..must have a NIE. So, if he/ she doesn´t have work or residence permit, has to apply for this number for tax tasks.
Hasta este verano, era muy usual solicitar el NIE en la Agencia Tributaria o policía, mediante un poder y copia legalizada del pasaporte, por los abogados en España. Ahora este procedimiento, ya no es posible y se ha de realizar personalmente por el interesado.

Since last summer, it was the most usual to apply for the NIE at the Tax Agency or the Police, through your lawyer in Spain, sending him/hers a legalized copy of the Passport, and an empowerment. Nowadays, this proceeding is not possible and must be done directly by the interested person.

Si el interesado esta en España, puede solicitarlo directamente en la policía y en la Agencia Tributaria. Si no está en España, tiene que realizar los trámites en la Oficina Consular de España en su país.

If the interested person is in Spain, he/she can apply for it directly at the Police or the Tax Agency. If not, he/ she must apply for it at Spain Consulate, in his/hers country.

Con la solicitud aportando la copia legalizada del pasaporte y el modelo 030 junto a los poderes, y siempre que se demuestre que hay urgencia, por ejemplo de una constitución de una sociedad con fecha de firma, lo cual se demuestra mediante escrito notarial, la Agencia Tributaria nos proporcionara un NIE provisional para realizar esta constitución en el notario.

With the justification of the applying as well as the legalized copy of the passport, the tax model 030 and the empowerment , and demonstrating by a document from the Public Notary there´s an urgency, like having to constitute a company with date of firm, the Tax Agency will give us a provisional NIE in order to be able to carry on the predated company´s constitution.
